Welcome to Inkive.
These Terms of Use ("Terms") apply to your access to and use of the Inkive app and related services ("Service"). The Service is provided by independent developer Xuanwei Sheng ("Developer", "we", or "us").
Please read and understand these Terms carefully before using the Service, especially the disclaimers and limitations of liability. If you do not agree to any part of these Terms, please stop using the Service. By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
Inkive is a reading-oriented capture and organization tool that provides image-based clipping extraction, text organization, and export features.
The Service supports capturing or importing images of book pages, automatically identifying marked content such as underlines, highlights, and circled text, and restoring and organizing the extracted text.
The Service also provides clipping management, including organization by book, notes, full-text search, and export features such as Markdown and share images.
We may continue improving recognition quality, sentence handling, and the overall experience. Such updates may require you to update the app.
Some features of the Service may be used without registration. Some features may require sign-in.
You are responsible for safeguarding your account information and for all activity under your account.
You must not impersonate another person or account, or engage in unlawful or unauthorized activity.
You are responsible for the content you capture, import, or enter.
You represent that you have lawful rights to use such content and that you will use it only for personal reading excerpts.
The Service is a technical tool and we are not responsible for the legality of your content.
If improper content is found, we may remove or restrict it where applicable.
The Service uses OCR and algorithms to extract marked content automatically. Results may contain errors, including missed recognition, incorrect recognition, or sentence segmentation issues.
You should review the recognition results yourself. We do not guarantee that they will be completely accurate or complete.
Data processing for the Service follows the Inkive Privacy Notice.
Book page images, recognition results, clippings, and notes are stored locally on your device and are not uploaded to our servers.
The Service may offer free and paid features, including auto-renewable subscriptions such as an annual membership.
If you purchase an Inkive Pro auto-renewable subscription, you agree to the following terms:
(1) Payment: Payment will be charged to your iTunes account when you confirm the purchase.
(2) Auto-renewal: Your subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current subscription period.
(3) Renewal charge: Your account will be charged for renewal within 24 hours before the end of the current subscription period. After successful payment, the subscription period will be extended.
(4) Management and cancellation: After purchase, you can manage or cancel your subscription at any time in iOS Settings -> Apple ID -> Subscriptions.
(5) Free trial: If a free trial is offered, any unused portion of the trial period will be forfeited when the user purchases a subscription.
As required by Apple, the following terms are included:
(1) Parties: These Terms are concluded only between you and the Developer, Xuanwei Sheng. Apple Inc. and its subsidiaries are not parties to these Terms and are not responsible for the App or its content.
(2) Maintenance and support: The Developer is solely responsible for providing maintenance and support services for the App. Apple has no obligation to provide maintenance or support for the App.
(3) Warranty and refunds: The Developer is responsible for the quality and availability of the App. To the maximum extent permitted by applicable law, Apple has no warranty obligation. If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price. After any refund, Apple has no further warranty obligation with respect to the App.
(4) Product claims and third-party infringement: The Developer, not Apple, is responsible for addressing any user or third-party claims relating to the App, including product liability claims, compliance claims, and intellectual property infringement claims.
(5) Third-party beneficiary: You and the Developer acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms. After you accept these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
The Service is provided "as is". We do not guarantee recognition accuracy, service stability, or continuous availability.
We are not responsible for consequences caused by recognition errors, data loss, or use of results, except where otherwise required by law.
We may modify or terminate the Service as needed.
If you violate these Terms, we may restrict or terminate your access to the Service.
You may stop using the Service at any time.
The software, algorithms, and related content of the Service are owned by the Developer or relevant rights holders.
You may not copy or use them for commercial purposes without permission.
These Terms are governed by the laws of the People's Republic of China.
Disputes should be resolved through negotiation. If negotiation fails, disputes shall be submitted to the competent court at the Developer's location.
If any part of these Terms is invalid, the remaining parts remain in effect.
These Terms constitute the entire agreement.
